ANALYSIS OF LEGITIMACY OF THE INTERNATIONAL CRIMINAL TRIBUNAL FOR THE FORMER YUGOSLAVIA

The events of the war in the former Yugoslavia resulted in the establishment of the International Criminal Court for the former Yugoslavia (ICC) designed to trial persons responsible for serious violations of international humanitarian law. This ad hoc court, unless a trial, has had a mission to, by its verdicts, end one tragic period and to contribute to the creation of lasting peace within this region. But today, 22 years since its establishment, by the analysis of what has been done so far, we can see that this court is very far from the utopian ideal of international justice and that, because of its biased, one-sided and selective approach, contributed has lost its legitimacy for making any verdicts, especially those that should contribute to calming tensions in the region.
