Abstract

The work points out some aspects of the detention, and first and foremost the legality of depriving of liberty, rights of persons deprived of liberty and the necessity of urgent treatment in detention cases. Also, it draws attention to the need to review the decision on being deprived of liberty and a detailed explanation of this decision, in particular the danger of the repetition of criminal acts as the basis for determining custody. This paper suggests a greater number of decisions of the European Court of Human Rights on issues discussed in this paper, noting that these decisions establish standards that must be respected when it comes to measures, which takes away the basic human right, the right of freedom. At the end of the work conclusions are made, stating that our country is generally adhered to standards that have been established by the decisions of ECHR, noting that instead of detention, alternative measures that secure the presence of the defendant in criminal proceedings, should be applied more often.
