THE PRESUMPTION OF INNOCENCE AND THE MEDIA

After the introductory part, the paper determines the concept of the presumption of innocence, stating that it is an indispensable guarantee in relation to the defendant's position. It is emphasized that it is one of the fundamental rights of the defendant, and that its effect is multiple, that is, it is linked to the basic principles of criminal procedure law, first of all with the principle of in dubio pro reo, as well as with the burden of proof which is on the prosecutor. In addition, it is pointed out that informing citizens through the media about the course of the proceedings and certain criminal matter is required and allowed, but it is necessary that it is done objectively and without prejudging the guilt of the accused and the court's decision. In following are listed the provisions stipulated for the protection of the presumption of innocence, which are contained in regulations governing the work of journalists. It is further suggested the possibility of quashing a verdict that would have been the result of violation of the presumption of innocence, stating the legal basis for filing an appeal. At the very end of the paper, the solution that existed in the 2006 Code of Criminal Procedure is analyzed, while the opinions on the consequences of the violation of the presumption of innocence and possible solutions in order to protect this presupposition are presented in the conclusion.
