INSTRUMENTS OF DIRECT DETERMINATION OF ADRESEES’ BEHAVIOUR IN THE FIELD OF ENVIRONMENTAL LAW

The objectives and principles of environmental law are achieved through appropriate legal and other instruments to ensure the desirable behavior of the corresponding entities. By their nature, these instruments can be direct and indirect. Unlike the indirect ones, which provide certain incentives to persons who act in accordance with the principles and norms of the environment, the direct instruments require the legally binding behavior of all or some of the categories of persons in order to protect the environment. The paper deals with the direct instruments of public legal origin, such as legal prohibitions and orders, as well as the control and repressive instruments by the state administration bodies. The author points out the character and necessary connection between these instruments. Preventive legal prohibitions are thus necessarily linked to the permissions of administrative authorities, while repressive prohibitions are linked to the individual or the group exemptions from their application.
