COLLECTIVE EMPLOYEES RIGHTS – SITUATION AND PERSPECTIVES

The collective rights of employees, no matter how it was analyzed in the XXI century, recognized, implemented and protected, could not exist without individiulanih labor rights. Thus, all known regarding collective rights of employees would remain "a dead letter", if not adequately exercised individual labor rights. That impact has repercussions, and the exercise of individual labor law is adequate if there is implemented a collective rights of employees. Precisely on the basis of the above, we are witnessing a certain stagnation, both in developing and in the current collective rights of employees, which is a prerequisite, in addition to individual labor rights and good status and bargaining position of trade unions and works councils. The collective rights of employees and the situation of trade unions (councils) stands in direct proportion - strong and influential trade union, as a rule means the effective exercise of the collective rights of employees, or at least some of them, which in theory and practice applicable to most. As the transition period took its toll on the economy of the Republic of Serbia, and is clearly weakening the negotiating position of union councils, it is natural to expect that the collective rights of employees or compromised or in practice do not even realize. Does this mean that the perspectives of the development of collective labor rights are not to be optimistic and access to the root change in this area? Although fluctuations in the development of the collective rights of employees existed in the past, what is specific to the current situation is, in addition to conditionality economic and political situation, and rapid technological development, digitization, and negotiators disproportionate relationship between employers, unions and the state. However, in earlier periods in which the collective rights of employees experiencing crisis and stagnation, it is necessary to look for an answer to the question of how to make the perspective of development and realization of the collective rights of employees to be better than those that can currently be expected.
