EUROPEAN COMPANY IN THE LEGAL SYSTEM OF THE REPUBLIC OF SERBIA

The process of harmonization of legal system of the R. Serbia, through accession negotiations with the European Union, represents the most demanding segment of the procedure itself. The entire legal system must be integrally connected with the fundamental legal solutions that are valid in the member states of the European Union. The reform of the legal system through accession negotiations is a key segment of such a process, while in the reform of corporate law it is a very important segment of the same. In this paper, the authors deal with the integration of normative solutions within the Companies Act, as a systemic regulation of what is called corporate law in the broader context in the European legal field. An important segment of this process is the normative integration of a special form of business entity, which as such is taken over from the valid directives of the European Union, and integrated into our legal system. It is a European company, ie a European joint stock company. The subject of the research is the normative analysis of the way in which the legislator in R. Serbia has legally integrated this institute within the Companies Act. The paper aims to analyze the relevant provisions of the Companies Act in the mentioned domain, as well as the legal context of such solutions with special legal implications for domestic law.
