IMPROVING THE INVESTIGATIVE POWERS OF THE COMMISSION FOR PROTECTION OF COMPETITION OF THE REPUBLIC OF SERBIA

The author in the paper identifies the lacks in the investigative powers of the Commission for Protection of Competition of Serbia and gives recommendations for improving the legal powers of the Commission. The aim of the paper is to provide guidelines for improving the set of investigative powers of the Commission for Protection of Competition of Serbia. The research focuses on the application of the competition protection law in the field of restrictive agreements and the abuse of dominant position. The central part of the paper is a comparative analysis of the investigative powers of the Commission for Protection of Competition of Serbia and the European Commission. The research suggests that the set of investigative powers of the Commission for Protection of Competition is incomplete. The above stated imposes the need to improve the powers of the Commission for Protection of Competition of Serbia, according to the model of the European Commission, as follows: inspection powers, legal instrument of request for information and instrument of interview.
