SEPARATION OF POWERS IN AUTONOMOUS REGIONS AND LOCAL GOVERNMENTS

The Constitution of Serbia from 2006 proclaimed the principle of separation of powers, as a key principle and basic principle of the organization of state power. This principle was reinstated by the Constitution form 1990, which created a discontinuity with respect to the constitutional solutions hitherto envisaged the principle of unity of power, the assembly principle in which the assembly represented the highest authority. Separation of power implies that power is divided into legislation, executive and jurisdiction and that there is a balance and cooperation between them, as envisaged by the Constitution of Serbia, which adopts a parliamentary system of separation of powers, as opposed to another form of separation of powers, the presidential system, which is also adopted in many other countries, where differentiation between branches of government is more rigorously carried out.
Apart from the horizontal division of power, its vertical division is also significant for the organization of power, and by this principle, which constitutionally and legally resolves, which in practice differs from normative solutions, deviates greatly from the constitutionally proclaimed organization of power on the principle of separation of powers, both in autonomous provinces and in local governments.
