TRANSFORMATION OF THE INSTITUTION OF IMMISSION AND THE CIVIL CODE DRAFT

Abstract

In this paper the author points out that nowadays the institution of immission exceeds the framework of neighboring rights, where it has traditionally belonged to, and represents an important limitation to the right to property in public interest that also provides for the environmental protection. Thus, the liability for immissions cannot exclusively refer to an illegal impact on the neighboring property rights any more, but has to be extended to include those cases in which someone emits something harmful into the environment, which affects the common society. Today the institute of immission needs to be interpret in a wider and more comprehensive way.

Rules of Civil code draft apart from certain terminological expressions do not make any step forward with the aim to offer more comprehensive and modern regulation of the institute of immission. In Civil code draft immission protection is unjustifiably narrowed down. Despite technological development there are not mentioned any modern types of immissions. However, the introduction of a general provision that requires protection, improvement and enhancement of a healthy environment as general ownership limit should led to stronger connection between some civil law institutes as well as with principles of sustainable development.
