JUSTIFICATION OF TERRORISM EXAMINATION AS A CATEGORY OF CRIMINAL LAW

The paper deals with the importance of the study of terrorism as a category of criminal law and offers arguments that support the justification and the necessity of more intensive study of this negative social phenomenon from the aspect of criminal law. The author offers a desirable structure of research on this topic, setting certain hypotheses as the basis of the research on this subject. There are also some basic problem questions that follow the study of this category of delicts and are related to the characteristics of criminal law as only one of the mechanisms of social reaction to this difficult form of crime. The paper emphasizes the importance of studying the methods, models and content of criminal defense against terrorism, starting from the international, comparative aspect, to the aspect of standardizing this phenomenon in the positive criminal legislation of the Republic of Serbia. Special attention should be paid to the problem of the borders and possibilities of criminal protection against terrorism, as well as its adequacy in relation to this type of crime, from the aspect of the possibility of achieving general and special prevention, as well as issues of adequate implementation of the criminal law norm, which is in function of the desired degree crime prevention.
