HATE SPEECH, EXISTING PROBLEMS AND NECESSARY MEASURES

In this paper we will try to analyze the existing problems and doubts related to defining and punishment of hate speech. We will pay special attention to communication on the Internet and on-line media.
We will point out identified deficiencies and provide suggestions for concrete solutions. We will problematize the issue of defining hate speech, the necessity and justification of punishing hate speech with emphasis on the experience of foreign legal systems.
We will propose the necessary changes in the criminal and other legislation of Bosnia and Herzegovina and its entities. Emphasis is placed on the complete absence of legal regulation of media activity on the Internet in order to show that the current legal solutions are inadequate because certain important issues, such as the issue of criminal or any other responsibility of Internet service providers which are not covered by existing legislation, while to some other issues is not given adequate significance.
