THE IMPORTANCE OF THE JURISPRUDENCE OF THE EUROPEAN COURT OF HUMAN RIGHTS FOR THE PRINCIPLE OF NON-DISCRIMINATION IN REGARD WITH INHERITANCE RIGHTS

The jurisprudence of the European Court of Human Rights in the field of the inheritance law is of great importance, having in mind that in some cases it was identified the violation of the right to respect for private and family life guaranteed by the Article 8, as well as of the principle of the prohibition of discrimination guaranteed by the Article 14 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. Judgements of the Court dealing with inheritance rights had a significant impact on the harmonization of the national legislations with the European legal standards and trends. The aim of this paper and its research is to analyze the jurisprudence of this Court in the context of its impact and significance in the field of inheritance law.
