REVIEW OF THE AUTHORIZATION OF WORKERS FOR SECURITY OF PEOPLE AND PROPERTY IN THE REPUBLIC OF MACEDONIA IN THE CONTEXT OF RESPECT FOR HUMAN RIGHTS AND FREEDOMS

Abstract

Subsystem of private security (PSS) in the Republic of Macedonia (RM), as one of the countries in transition, is developing in direction of the CoESS concept and parallel to the other countries of former Yugoslavia, varies considerably only in relation to Slovenia and Croatia.

Authorizations of workers in the agencies for securing people and property (ASPP), as one of the PSS subjects in the RM, are defined in Law for securing people and property (LSPP) passed 1999, which still doesn’t sustained significant changes, especially not in the part of the authorities. Incomplete and imprecise definition of them, and the way of their application as well, open a space of dilemmas in the practice, which threatens the safety of the immediate perpetrator, as well as colleagues and citizens with whom they come in contact with. That, on the other hand, increases the possibility of abuse of the authorities, which violate the human rights and freedoms of citizens towards whom they are applied. For this reason, was conducted this research, with aim of determining the current state of knowledge and the character of present dilemmas in applying the authorities, with ultimate aim of drawing conclusions about the direction and form in which have to be made changes and activity. In the draft plan about improving this problem, the first step refers to some concrete and conceptual changes in the legislation, as a precondition for the functioning of this security segment, comparatively with other countries, where as such a concept has already been successfully implemented. While, the second step are concrete activities and proposed measures, which are related to changes in the subsystem and their practical implementation, and which are mainly related to training / additional training, cooperation and control.

The results show that in relation to LSPP is recommended precise some of the terms, introduction of new and development of present authorities in secondary legislation, which correspond with the new proposal of LSPP, which is submitted in the parliamentary procedure. In that, as the main obstacles to full harmonization of regulations with a CoESS are poor economic situation in the country and low levels of safety culture among the citizens. In relation to the measures and activities, is proposed: increasing the effectiveness of training, especially in the practical part – continuous additional training in the application of the authorities, particularly for the difficult one; the differentiation of the authorities in accordance with the workplace in ASPP; adding new types of private security and introduction of separate licenses and criteria for different types; introduction operational components such as prevention, particularly in the transport of money; delineation of the authorities and initiation of activities for improving the cooperation with the police and more effective control, as important aspects of successful realization of work tasks and higher security; and in terms of adequate training, ASPP workers may obtain the status of authorized officer.
