PROSECUTORIAL AND POLICE LEGAL WORK IN INVESTIGATION AS A PRECONDITION FOR FAIR TRIAL IN CRIMINAL PROCEDURE IN BOSNIA AND HERZEGOVINA

Abstract

In a light of new legal solutions in european countries, most accepted model for criminal procedure is prosecutorial investigation, and obligatory subject of investigation are police service and law enforcement agencies which work of discovering and resolving crime offences is under prosecutors supervision. This concept of investigation is, counting each country of former Jugoslavia, first accepted by Bosnia and Herzegovina a it is in use since 2003. Considering the fact that, by ten years of conducting mentioned model, goals of making investigation more efficient are realized and, from the other side, as a balance, there are efforts to protect basic human rights more rigorously by protecting the right on fair trial. Authors in this academic paperwork, after introductory speeches and short presentations on international and home sources to exercise right on fair trial, will present short review on prosecutorial and police legal work in preliminary proceedings in Bosnia and Herzegovina, which represents precondition for implementation fair trial principle, and also existence of procedural guarantees which provide to suspect persons equal possibilities of influence on process and results of investigation and main proceedings, with special accent on the exercising their access to information right.
