ITALIAN MODEL OF THE PRELIMINARY CRIMINAL PROCEEDINGS

The Italian criminal procedure code of 1988 reformed Italy’s criminal procedure system from an inquisitorial or continental model into adversarial system. Therefore, a set of changes was introduced into the preliminary criminal proceedings. In this paper the author is dealing with characteristics of the preliminary criminal proceedings in Italy and their foundations. A great deal of attention will be paid to the role of three specific parties in the preliminary criminal proceedings: public prosecutor, court and police. Basic characteristics of the preliminary investigations will be considered as well as their importance to further criminal procedure, but also preservation of evidence and preliminary hearing which are not characteristic for countries of the continental European tradition. Finally, special attention will be paid to the most important challenges faced by Italy during new system implementation.
