THE INCRIMINATION OF HATE CRIMES – A VIABLE PATH TOWARD MORE EQUAL SOCIETY

Abstract

In this article, the author analyzes issues relevant to the hate crimes and discusses the way those crimes are treated in the newly enacted Law on amendments and addendums of the Criminal Law of the Republic of Serbia. According to the adopted document hate crimes are envisaged to present aggravating circumstance instead of being treated as separate crimes. Given the fact that hate crimes are particularly perilous criminal deeds with the impact on society as whole and request for certain groups to be outcast from society, the separate incrimination of those crimes seems to be the only righteous and functional way of resolving the inequality problems said crimes bring to democratic societies. To achieve functional difference in population, the difference has to formally safeguarded, and hate in hate crimes recognized as political hate qualitatively differing from other motives and circumstances in Criminal Law. Uncontrolled bigotry typical for transitional societies is additional necessity for the establishment of the rational pluralism and the elimination of egoistic aspirations striving for the singularistic society of the equals as uniformed. The author considers that with the adequate incrimination of hate crimes a difference might be perceived as equality.
