THE INFLUENCE OF MORALITY ON CRIMINAL LAW

The author considers in work the problem of the influence of morality on criminal law. Although the impact of morality is minimal nowadays, it is still present. A current Criminal Code contains certain incrimination that reflect the influence of morality. In particular, the author discussed certain crimes against sexual freedom, and in this regard the phenomenon of prostitution, which basically is not punishable in criminal law but some aspects of that phenomenon are punishable. It is also analyzed the influence of morality on criminal offenses against marriage and family. Also, the issue of indirect punishment of drug addiction is considered because it is in the main „ratio legis“ of the offense of unauthorized possession of drugs. In this regard it will be discussed and the phenomenon of "victimless crimes" in the context of the presence of a moral element in this category of crimes.
