CRIMINAL OFFENSE KIDNAPPING IN CRIMINAL LEGISLATION OF THE REPUBLIC OF SERBIAN

After the introductory part where it is mentioned that an abduction has four harder forms besides its basic form, in the work the basic form is analyzed first while actions of committing, means and goal of committing this criminal act are explained. All the harder forms are analyzed in detail while pointing out some of dilemmas which exist at qualified forms of abduction, taking a suitable attitude about disputable questions and stating the arguments that defend such an attitude. It is particularly distinguished, for example, that in a situation where more persons are abducted in one action it is not spoken about only one act, but as many acts as many persons are abducted. Since this solution is not justified enough, in the work it is suggested to prescribe a qualified form that would exist in the case more persons were abducted. Along with this suggestion, in the part of work where proposals in de lege ferenda sense are presented, other suggestions for changing and annexing of this criminal act are stated. In the end of the work conclusions are made.
