THE LEGAL CONSEQUENCES OF BREACHES OF PROFESSIONAL SECRECY DUTY

Abstract

It is the duty of professional secrecy is simply one that is specified in the Companies Law as a special obligation to certain categories of persons in the corporate management of the company. Information security, and data is a very relevant issue for any company. The subject of the research work are the legal consequences of breaches of duty of professional secrecy. In the first segment of the conceptual work is to determine business secret. The complexity of this issue manifests itself in the fact that a trade secret is conceptually defined in three legal acts, which consequently requires a comparative analysis of the given concepts. Other segments of the work analyzes the legal consequences of breaches of duty of professional secrecy, pursuant to the provisions of the Companies Law. Legal consequences for the offender may be criminal, property and labor charahcter. A significant part of the work is based on the normative analysis of the offense - Disclosure of trade secrets, which is criminalized in the Criminal Code of the Republic of Serbia. The aim of the research is a normative analysis of relevant legislation which establishes the scope of the legal consequences for the person who has disclosed a trade secret, as well as the quality of the statutory protection of the interests of business entities.
