THEORETICAL ASSUMPTIONS AND IDEAS ABOUT LEGAL STATE

We see that every day talking about the need to establish the rule of law in order to eliminate the presence of systematic lawlessness in society. The story of the rule of law is a fundamental starting point in every election campaign that does not waive any of the political parties. As a reminder, at a time when our country was part of the former Yugoslavia, which was ruled by one party, the political preoccupations 's gross violations of human rights of individuals covered liberalize the need to preserve the rule of law. Also, the exercise of police torture followed unsolved murders and incomplete investigations, was performed again in the "name of the rule of law." Rule of law is a subject of interest publicist minded individuals and organizations achieve their proclaimed goals done for the sake of establishing the rule of law. Not rare authors with poor legal knowledge polemic on the state of law equating it with the need to establish democracy, a multiparty system, freedom of the media, independence of state institutions, universities etc. Although these conditions without which we can not talk about the existence and successful functioning of the rule of law, it is wrong to equate them with the rule of law.
Encourage the expansion of lay and unscientific treatment of the rule of law, the authors decided that those who do know about it only reminded of, but most of those on the rule of law a know little, but I keep on it discuss, remind the theoretical assumptions and ideas upon which it rests. Guided by this goal, we will point out the basic theoretical assumptions that have laid the foundation for building the rule of law. Since the theoretical frameworks preceded the idea of the rule of law, special attention will be paid to their appearance and development to the point where they become an integral part of important international legal documents.
