Abstract

A modern democratic society can not be imagined without free media. The freedom of journalistic research must be legally protected from various political and other negative influences, but must be legislative and limited. In this paper we will point out some of the aspects of the negative effects of the media, especially those who are in the brink of violation of the principle of the presumption of innocence. The research of the issues arising from the title of this paper is conceived in several segments, starting from certain aspects of negative action, which is just mentioned, and through pointing and examining the question of the presumption of innocence. Then, the issue of legislative protection under the Law on Public Information and the Media will be considered, while a special part of the work will be devoted to considering the responsibility for advertising information about the outcome of the criminal proceedings in the media. In the last part of the research, the basic hypothesis of this paper dealing with misdemeanor responsibility and penal policy based on the Law on Public Information and Media will be especially considered. The aim of this research is not only to point to this issue, which is relatively often represented especially in the sensationalist transmission of information, but also to suggest some legislative changes.
