CONCEPTUAL THEORETICAL DILEMMAS OF PUNISHMENT

In this work, the authors deal with conceptual theoretical dilemmas which refer to the punishment. The authors, through a philosophical and legal approach, consider the essence of the punishment, its purpose, goal, justice, justification of the pronouncement and its influence on the correction of behavior, that is, the re-socialization of the convict himself. In contemporary criminal policy, it is increasingly seeked to raise the level of humanity and reduce the level of repression towards the perpetrators of criminal acts. However, by denying the repressive nature of the punishment and the character of retribution, done is practically abolished, and the criminal is approached as a patient who needs healing, so that in the future he would not exhibit the symptoms of the disease at the expense of others and himself. And while society’s part in the etiology of criminal behavior should not be negated, it must be borne in mind that criminality is not an illness in a medical sense of that word. With the fact that certain prohibited behavior is carried out consciously and with the knowledge of legally determined consequences, punishment is the answer to the impudence of a criminal who denies the importance of social norms, negates other people's rights and sets the state of self-will.
