CHILD’S WILL AS THE BASIS FOR DECISIONS IN CASES OF UNLAWFUL REMOVAL OF A CHILD FROM HOMECOUNTRY

Abstract

This paper focuses on the child's will as one of the reasons for rejection of a request for his/her return to the country of residence prior to unlawful removal or retention according to the Hague Convention on the Civil Aspects of International Child Abduction, and the manner of determining child's attitude in several selected legislations. Child's rejection to return may be taken as the grounds for rejecting the request for his/her return in cases when judicial or administrative bodies conclude that the child has reached an age when he/she is mature enough to have his/her opinion taken into consideration. With the aim of making a comprehensive consideration of this exceptin to the urgent return of a child, which is the objective of the mentioned convention, an analysis of 50 court decisions from different countries was made. The results of the analysis as well as the statistical data from the Hague Conference on International Private Law showed that the child's oppositon has rarely been the reason for the court to reject the request for child's return. According to the latest statistical data from 2015, there have been no requests in our country that were rejected for the said reason. Furthermore, the methods applied in accordance with national legislation and several other legislations for obtaining child's opinion were also analyzed. The results indicated that there are two kinds of methods in the included countries applied in the process of obtaining child's opinion, and those are either direct conversation between judge and the child, or the child and a qualified professional.
