Abstract

Plea bargaining of minor offence is a specificity that is reflected by the fact that in the circumstances stipulated by the law, the defendant and the authorized applicant, with the existence of mutual will, negotiate the type of misdemeanor sanction after the defendant accepts the misdemeanor liability. The positivelegal prediction of this institute is relatively new in domestic misdemeanor law, and therefore it needs to be further consolidated. Although some procedural segments of this institute raises questions of its justification, especially the purpose of punishment due to the possibility of agreement on the height and type of sanction, its application is more and more widespread in our country and in the world. The significance of the application of this institute is that the procedural efficiency of the court procedure is achieved, the reduction of court costs and the less process burden on process entities. The aim of this research is to point out the positivelegal prediction of this institute in the Law on Misdemeanors in Serbia with a parallel presentation of how the plea bargaining is foreseen in the German legislation and legislation of the United States.
